AN APPEAL BY PCT TO THE GLOBAL CHURCH FAMILY FOR PRAYERS CONCERNING THE ABUSE OF JUSTICE AND VIOLATION OF HUMAN RIGHTS IN TAIWAN

On behalf of the Presbyterian Church in Taiwan (PCT) and out of unyielding concern for the dignity and selfhood of the 23 million people of our nation, as well as for peace in the Asia region, we sincerely appeal to you our sisters and brothers in Christ to join us in expressing concern and offering prayers for Taiwan.

Ever since the Legislative Elections of January 2008 when the Nationalist Party (Kuomintang KMT) garnered the overwhelming majority of seats and later the KMT candidate, Ma Ying-Jeou, won the Presidential Election on 20 May 2008, the Presbyterian Church in Taiwan (PCT), along with many others in our land, have held deep concerns and reservations for the future of democracy and human rights in our country Taiwan.

Sadly, the performance of President Ma and his KMT administration the past six months has time and again underscored our fears. We in particular express our grave concern for recent events:

1) the detentions of both present and former government officials of the opposition party, Democratic Progressive Party (DPP) accused of corruption. We understand one or two detainees have been charged but several accused are still held without being charged and incommunicado, this is a basic violation of due process of justice and rule of law. Furthermore, we are concerned the prosecutor’s office is seemingly leaking information to the press while the accused are unable to defend themselves. This “trial by press” also violates justice and the norm that any accused should be considered innocent until proven guilty in a court of law. Since only members of the DPP opposition party are targeted this action implies the KMT is “using” the justice system to retaliate the former government under Chen’s administration.

2) the visit to Taiwan (3-7 Nov 2008) of Mr. Chen Yun-Lin, Chairman of the Association for Relations Across the Taiwan Strait (ARATS) from China; and the signing of the four cross-strait accords between the ARATS chairman Chen and the Straits Exchange Foundation (SEF) represented by its Chairman, Chiang Pin-Kung. This action to develop direct aviation, shipping, market trade and economic relations with China accelerated fears that the methods used by the Ma Administration are costly in terms of the legal process, Taiwan’s dignity and sovereignty as well as being a real threat to democracy in Taiwan.

3) the violation of human rights, freedom of speech and expression, undergirded by the government’s action to deploy more than 10,000 police including riot police officers, to Taipei city to “guard” the visiting dignitary Chen and the sixty people who accompanied him. These measures to “guard and protect” the visiting envoy from China were excessive and disturbingly reminiscent of the dark years under Martial Law.

With this letter we add a brief overview of some of the events of last week that hopefully will help you further understand the reason for our concerns.

Taiwan Police Violates Civil Rights When Maintaining Order During the Meeting of Taiwan’s and China’s Top Negotiators

 

Η Αστυνομία της Ταιβάν Παραβιάζει Πολιτικά Δικαιώματα  Καθώς Διατηρεί την Δημόσια Τάξη Κατά τη Σύνοδο των Κορυφαίων Διαπραγματευτών Ταιβάν και Κίνας

 

Ο Τσεν Ιουνλιν, επικεφαλής της Οργάνωσης Σχέσεων Κατα Μήκος του Στενού της Ταιβάν, προσγειώθηκε στη Ταιβάν στις 3 Νοεμβρίου. Υπέγραψε συμφωνίες για επιβατικές-εμπορικές πτήσεις, την εμπορική ναυσιλία, ταχυδρομικές υπηρεσίες και θέματα ελέγχου τροφίμων με τον Τσιάν Πικ-κουν, επίτροπο της Οργάνωσης Συναλλαγών του Στενού. Αυτές οι συμφωνίες εισάγουν στις σχέσεις Κίνας και Ταιβάν τρείς άμεσες επαφές. Θα επισκεπτόταν και τον Πρόεδρο Μα Ιν-Τζιου της Ταιβάν.

 

Για αρκετό καιρό η Κίνα εμποδίζει την Ταιβάν να συμμετάσχει σε διεθνής δραστηριότητες. Η Κίνα δεν αναγνωρίζει την εθνική ιδιοτέλεια της Ταιβάν, ούτε ακυρώνει τα σχέδια πιθανής στρατιωτικής εισβολής. Πολλοί Ταιβανέζοι, συμπεριλαμβανομένου του μεγαλύτερου κόμματος της αντιπολίτευσης, το Κόμμα Δημοκρατικής Προόδου (Ντι Ντι Πι), ανυσυχούν πως η κυβέρνηση της Κουομινταν θα αδυνατήσει να υπερασπιστεί την αυτοκυριαρχεία της Ταιβάν. Ακόμα επισημαίνουν την έλλειψη δημόσιας διαφάνειας της συνάντησης. Οργανώνουν διαμαρτυρίες κατά τη διάρκεια επίσκεψης του Ιουνλιν στη Ταιβάν, με συνθήματα όπως “Μία Ταιβάν, Μία Κίνα”. Αυτοί που διαφωνούν με την βίαιη καταστολή του Θιβετιανού κινήματος συμμετάσχουν στις διαματυρίες με το σλόγκαν “Ελεύθερο Θιβέτ”.

 

Για την επίσκεψη του Τσεν Ιουνλιν, η κυβέρνηση της Κουομινταν έχει επανδρώσει κάπου 7 χιλιάδες αστυνομικούς και ειδικούς πράκτορες για να ασφαλίσει τις περιοχές οπου ο Τσεν θα παρευρεθεί, με σκοπό να αποτρέψει τη δημόσια κατακραυγή. Τα αστυνομικά μέτρα προφύλαξης του Τσέν αυτές τις μέρες έχουν, παραταύτα, ξεπεράσει τα όρια του νόμου και του συντάγματος και έχουν προσβάλει σοβαρά τις ατομικές και πολιτικές ελευθερίες των πολιτών. Αναφέρουμε κάποιες περιστάσεις:

 

1. Η αστυνομία κατέσχεσε και κατέστρεψε ιδιωτική περιουσία όπως σημαίες και μπαλόνια διαδηλωτών.

 

2. Το βράδυ της 2 Νοεμβρίου, τέσσερις δημοτικοί υπάλληλοι της Τάιτσιονγ, οι Τσεν Σου-χουα (陳淑華), Τσιου Σου-τσεν (邱素貞), Τσι Λι-ιου (紀麗玉) και Λάι Τσια-ουέι (賴佳微), διανυκτέρευσαν στο Γράντ Χοτέλ όπου και θα έμενε ο Τσεν Ιουλιν. Το επόμενο πρωί ανέβασαν πανό διαμαρτυρίας από το μπαλκόνι του δωματίου τους. Μέσα σε ένα λεπτό, ειδικοί πράκτορες διαρήξαν το μπαλκόνι και εισβάλαν στο δωμάτιο τους, χωρίς τη συγκατάθεσή τους, αφαίρεσαν το πανό και τους ακινητοποίησαν.

 

3. Τρείς μπλόγκερς που κρατούσαν εθνικές σημαίες της Ταιβάν και του Θιβέτ απομακρύνθηκαν βίαια από την αστυνομία καθώς περπατουσαν νότια κατά την οδό Τσουάν Σαν (Βόρεια) και απέναντι από το Κτήριο Τσιμέντου Ταιβάν, όπου ο Τσεν Ιουλιν επισκεπτόταν την Σεσίλια Κοο Ιέν, χήρα του πρώην επίτροπου της Οργάνωσης Σχέσεων του Στενού. Η σύλληψη προκάλεσε την εξάρθρωσή των δαχτύλων ενός από τους μπλόγκερς, αλλά η αστυνομία αρνήθηκε να της επιτραπεί ιατρική περίθαλψη εώς ότου δώσει τα προσωπικά της στοιχεία.

 

4. Ο Τσεν Ιου-τσιν (陳育青), ένας φωτογράφος που επισκεπτόταν φίλους του κοντά στο Γράντ Χοτέλ, συλλήφθηκε και αποστάλει σε αστυνομικό τμήμα για ανάκριση επειδή γύριζε με φωρητή καμερα την ασφαλισμένη περιοχή.

 

5. Ο Χουν Τσιέν-Γι (洪建益), δημοτικός υπάλληλος της Ταιπέι , εισήλθε στο Αμπάσαντορ Χοτέλ, όπου βρισκόταν δεξίωση υποδοχής του Τσεν Ιουλιν, το απόγευμα. Καθώς έφευγε μόνος του το βράδυ, τον τραβήξαν βίαια σερνόμενος για δεκάδες γιάρδες από αρκετούς αστυνομικούς στην κεντρική είσοδο του ξενοδοχείου. Δεν είχε φωνάξει αδιάκριτα συνθήματα παρα μόνο φωρούσε μία φανέλα με στάμπα που έγραφε "Καμία Συνομωσία με την Κίνα".

 

6. Στις 4 Νοεμβρίου, καθώς ο Τσεν Ιουλιν βρισκόταν σε δεξίωση υποδοχής από τους ηγέτες της ΚΜΤ στο Αμπάσαντορ Χοτέλ, ένα κοντινό δισκάδικο έπαιζε Ταιβανέζικη μουσική δυνατά. Η αστυνομία αποφάσισε πως η μουσική ίσως να προκαλέσει τα συναισθήματα των διαδηλωτών, οπότε, με στολές ή αστικά, υπό την αρχηγία του Αρχηγού της Αστυνομικής Διεύθυνσης Περιοχής Μπέιτου, Λι Χαν Τσιν, εισέβαλαν στο κατάστημα, διέταξαν τον ιδιοκτήτη να σταματήσει τη μουσική και έκλεισαν την πόρτα.

 

7. Στις 3 Νοεμβρίου, η Ένωση Δημοσιογράφων Ταιβάν ανακοίνωσαν ότι ο Τσέν Τσιε-ουεν (鄭傑文), φωτορεπόρτερ του Κεντρικού Πρακτορείου Ειδήσεων, τραβήχθηκε από μυστικούς αστυνομικούς για δέκα μέτρα ενώ έκανε τη δουλειά του στο Γκράντ Χοτέλ, και ένα ανάρμοστο σχέδιο ενημέρωσης του τύπου είχε προκαλέσει διαφωνίες μεταξύ του τύπου και των διοργανωτών. Η ένωση δημοσιογράφων ανακοίνωσε ότι η ελευερία του τύπου είχε υποστεί σοβαρή επίθεση στη Ταιβάν. Εν τω μεταξύ, η κυβέρνηση εφάρμοζε τόσο σθεναρό έλεγχο της δημοσιογραφικής κάλυψης που κάποιοι ρεπόρτερς από το Χόνγ Κόνγ είπαν πως δεν μπόρεσαν να βγάλουν δημοσιογραφικές άδειες και είχαν ελλειπή δημοσιογραφικά δικαιώματα.

 

Η διαμαρτυρίες συνεχίζονται, όπως και οι πράξεις που προσβάλουν τα ανθρώπινα δικαιώματα, πράξεις που επιτίθονται στην ελευθερία του λόγου και των ατομικών ελευθεριών. Αυτές οι πράξεις δεν εναντιώνονται μόνο το ποινικό και πολιτικο δίκαιο της Ταιβάν, άλλα και το σύνταγμα της χώρας, το οποίο έπρεπε να είχε προστατεύσει τα δικαιώματα των πολιτών της. Θα παρακολουθούμε προσκτικά αυτά τα γεγονότα, και θέλουμε να προβάλουμε την αυστήρή απόρριψη της αστυνομίας της Ταιβάν.

Taiwan Police Violates Civil Rights When Maintaining Order During the Meeting of Taiwan ’s and China ’s Top Negotiators

 

Chen Yunlin, the chief of the Association for Relations Across the Taiwan Strait, landed at Taiwan on November 3^rd. He signed agreements on passenger-cargo flight, maritime shipping, mail service and food safety related issues with Chiang Pin-kung, the chairman of the Straits Exchange Foundation. These agreements made Taiwan and China enter an age of three direct links. He would also meet President Ma Ying-Jeou of Taiwan .

 

For a long time, China has repressed any opportunities of Taiwan to participate international events. China neither recognizes Taiwan as a sovereign nation nor gives up its plan of making martial intrusion into Taiwan . Many Taiwanese people, including Taiwan ’s biggest opposition party, Democratic Progressive Party, were worried that Kuomintang government would not be able to defend for Taiwan ’s sovereignty during the negotiation. They also questioned that this meeting was not put under public examination. They are holding protests throughout Chen Yunlin’s visit to Taiwan , expressing their claims, such as “One Taiwan, One China”. Those people against China ’s forceful repression of Tibet ’s independence activities also joined the protests, holding “Free Tibet” slogan.

 

For Chen Yunlin's Taiwan visit, the Kuomingtang administration has specifically deployed some seven thousand policemen and special agents to cordon off the venues where Chen would appear in an attempt to prevent the public from raising protests. Measures employed by the police to guard Chen these days have, however, gone beyond the bounds of the law and the Constitution and seriously infringed on citizens' personal liberties and civil rights. Following are some instances:

 

1. The policy confiscated and damaged personal belongings of flags and balloons held by people at protest venues.

 

2. In the evening of November 2, four Taichung City Councilors, Chen Shu-hua (陳淑華), Chiu Su-chen (邱素貞), Chi Li-yu (紀麗玉) and Lai Chia-wei (賴佳微), checked in the Grand Hotel where Chen Yulin would stay during his visit. The next morning, they displayed protest banners from the balcony of their room. Within one minute, special agents broke in the balcony and entered their room, without their consent, to remove banners and restrain their actions.

 

3. Three bloggers with national flags of Taiwan and Tibet in hand were forcefully taken away by the police when walking southbound along Chung Shan North Rd and passing by the Taiwan Cement Building, where Chen Yunlin visited Cecilia Koo Yen, widow of the former chairman of the Straits Exchange Foundation. The arrest caused the dislocation of fingers of one of the bloggers, but police refused to send her for medical treatment until she provided personal information.

 

4. Chen Yu-ching (陳育青), a photographer who visited friends near the Grand Hotel, was arrested and sent to the police station for interrogation for shooting the video of the banned area with hand-held camera.

 

5. Hung Chien-yi (洪建益), a Taipei councilman, entered the Ambassador Hotel, where Chen Yunlin’s dinner reception was held, in the afternoon. When leaving by himself in the evening, he was dragged away on the ground for tens of yards by several police officers at the front gate of the hotel. He did not shout derogatory slogans or carry any dangerous items but only wore a T-shirt with the mark of “No Conspiracy with China ” on it.

 

6. On November 4th, while Chen Yunlin was at the dinner reception hosted by KMT leaders at the Ambassador Hotel, a nearby record store was playing some Taiwanese song out loud. The police thought the song would stir up the feelings of the protesters on the scene, so they, in uniform or plainclothes, led by Beitou Police District Chief Lee Han Ching, broke into that record store, asked the store owner to stop the music, and shut the door.

 

7. On November 3rd, the Association of Taiwan Journalist issued that Cheng Chieh-wen (鄭傑文), a photojournalist from the Central News Agency, was dragged by the security police for 10 meters while he was doing his job at the Grand Hotel, and that an inappropriate press coverage area plan had caused quarrels between the press and the officials. ATJ declared that press freedom was under severe attack in Taiwan . Meanwhile, the government imposed such strict control over press coverage for this event that several reporters from Hong Kong said they failed to get press passes and had limited rights for coverage.

 

Protests are continuing, so are actions that invade human rights, actions that do harm to freedom of speech and personal liberty. These actions not only violated both Taiwan ’s criminal and civil laws but also contradicted the Constitution that should have protected the rights of people. We will be watching these events, and we want to raise our severe objections to the police in Taiwan .

給學生的一封信：請堅持你們對台灣社會的熱情、純潔與批判力

 

最近的台灣社會，上演了人權發展上倒退最快的一幕。我們可以不管發生這個事件導火線（陳雲林來台）背後的政治問題；我們可以不管政府在兩岸政策上的主張與調整；我們可以不管政黨的競爭與鬥爭；但是，我們不能不管人權這個基本價值被扭曲、被迫害、甚至被政治化成為工具。

 

民主、法治與人權，各自有很深的意涵；彼此有很複雜的關係。在台灣，這些都曾經是人民努力追求的目標，不管是主張兩岸統一還是台灣獨立；不管是主張台灣是中華民國的一部份、是中國的一部份、還是一個和中華民國、和中國都不相干的主權獨立國家。各種不同政治意見下，相同的堅持是對民主的信仰、對法治的支持、以及對人權的保護。民主、法治和人權，曾經在台灣是那麼遙不可及，在多少民主運動、反威權、追求人權的運動下；在多少白色恐怖、政治迫害、踐踏人權的過程中；在多少政治冤獄、奪取生命、族群歧視的陰影下，民主、法治與人權才能成為生活中理所當然的一部份、成為一種生活的方式。

你們或許不曾經歷追求這些基本價值的辛苦過程，或許沒有體會過只能有一個政黨、只能聽一個領袖、只有警察與憲兵，而沒有民主、沒有法治、沒有人權的生活。但你們已經能深切體驗不同政黨相互監督的意義、依法而治而非領袖獨裁的重要、以及享有基本人權的珍貴價值。這一切，現在是一種平凡的、毫不起眼的、沒有爭議的、日常生活裡的一部份。但這一切，同時也是容易在忽視中悄悄流失、容易在漠視中逐漸腐蝕、容易在不關心、不面對、不批判的情況下，不知不覺中就陸陸續續的退縮，一直到徹底消失。

年輕的可貴，在於你們有活力、有熱情、有希望、有著對家人、朋友與社會的關懷。而且這份關懷，是乾淨無暇的、是純傑的、是沒有政治意圖的、是沒有權謀交易的。你們的生活充滿著對音樂的喜愛、對運動的喜愛、對書籍電影的喜愛；充滿著對社團活動的期待、交友聯誼的期待、家人團聚的期待；甚至有著愛情的憧憬、未來的憧憬、實踐理想的憧憬。你們知道嗎，你們的喜愛、你們的期待、你們的憧憬，這一切的一切，都是在你們最習以為常的民主、法治、人權之下，才有了多元的、才有了自由的、才有了各式各樣的可能。

你們雖沒有經歷過，但可以想像一下這種生活：社會裡不准有異議；只能看特定電影、聽特定音樂、閱讀特定書籍；只能參加特定的社團、未來只能有特定的工作、一切的依據，都是唯一的政治領袖說了才算，而不是依據法律。可以有對家的想像，但家是被社會、被單一政黨、甚至被政治領袖用私有的警察、憲兵或特務所監視的。這種生活似乎很難體會，但卻不是危言聳聽。因為，他曾經就是20年前台灣的生活方式。

 

這幾天，警察可以在任意在路上架設有刀片的拒馬、警察可以任意要求民眾不准帶著旗幟上街、警察可以任意衝進店家要求關掉音樂、警察甚至可以用警棍毆打記者、路人或是三個聚在一起，就被疑為暴民的人民。

 

我們可以有特定的政治立場、可以有支持的政治偶像，但我們必須重視這種特定政治立場被尊重的基本精神，必須保衛包括自己在內，每個人都有自己特定看法的自由。因為這些是我們的權利，是我們之所以能自由的高談闊論、之所以能自由的創作、自由的享受生活的基本權利。

 

 

如果「取締非法、保障合法」要透過沒有具體依據就使用拒馬、警棍、盾牌、水柱，來把人民視為暴徒去毆打、把學生視為洪水猛獸的架離。我實在不知道，這種取締和保障，到底取締的依據是什麼，保障的對象又是什麼？

 

 

我們熱愛民主，因為民主是尊重人民、以民意為依歸的一種生活方式。我們服從法治，因為依法而治保障我們的權利、讓我們可以不必擔心有人可以犯錯而不受罰，我們更堅持人權，因為人權使我們可以有能力去熱愛民主、有能力去服從法治！

 

 

我真的希望，各位在校園的書堆中、i-pod的音樂中、社團或運動的聚會中、和男女朋友或家人的相處中、唱KTV、上網咖、寫部落格、看電影的生活中，也能維持著你們，或是再多一點點投入，對社會的批判、對自己現在好不容易有的生活方式多一點的關心，對民主、法治與人權多一點的認識。

這一切是那麼樣的得來不易，卻是那麼樣的脆弱。希望我們能一起珍貴它、保衛它、不要讓他開始受到扭曲而凋零、受到迫害而受傷、受到忽視而逐漸死去，最後帶走我們最習慣的生活方式！

〔駐歐洲特派記者胡蕙寧／新堡十二日報導〕英國發現疑似中國學歷集體造假事件；英國東北邊享有聲譽的新堡大學（Newcastle University）十一日出現罕見大動作，一舉開除五十名外籍學生，包括四十九名中國學生與一名台灣學生。該大學不願公佈學生姓名，只表示事件涉及偽造學歷，有留學申請仲介集團的非法行為介入。

仲介集團涉嫌偽造文書

新堡大學認為這些仲介商的本部在中國或英國，有些還是聲譽不錯的仲介商，偽造的部分甚至包含政府公證章，已涉及公文書偽造罪。

新堡大學並對英國所有大學發出警訊，注意來自這些國家的申請案件，不僅中國學歷被列嚴查對象，台灣有意申請留英的學生也可能受到波及。

英國大學靠學生繳費來維持收入，很多大學規定教授維持一定的「高過關率」，好讓大學下一年度招生當廣告用，要不是涉及非法，不會有大學隨便去開除收入的「飯碗」。新堡大學此次大舉開除五十名外籍學生非比尋常，其中有三十三名來念碩、博士，十七名來上大學課程，大部分都註冊進入商學院。新堡大學說，這一批被開除的都是新生，已經在過去幾週分別抵達英國註冊入學，大學跟學生約談後認為，不少人其實是仲介申請商的受害者，他們繳交一定的費用，仲介商全權受理申請文件、資格證件，申請人自己毫不知情。

偽造的主要部分是英文語言資格或是大學畢業學歷，這些文件偽造技術很好，大學行政部門人員無法用肉眼或一般審核看出虛假。

新堡大學將更動未來的入學審核標準，包括近期內公佈的新程序、新文件以及被認證許可的仲介商。這些舉動很可能蔓延到其他大學，台灣學子要申請英國學校，必須注意接下來可能的更動。

〔記者林曉雲／台北報導〕教育部國際文教處副處長許睿宏表示，目前尚未接獲新堡大學此個案的消息，不過台灣學生如果拿台灣學歷去申請英國大學，真實性沒有問題；台生若拿中國疑似造假的學歷申請英國的大學，則難免受到波及。許睿宏表示，教育部會再加強宣導和持續關心。

比[戒嚴]更恐怖!

一個中階的中國官員來到台灣，居然把台灣搞得天翻地覆，馬政府竟然實施比戒嚴時代更嚴酷的[暴政]，而綠營的人則體驗到面臨國共兩黨合作出賣台灣與國民黨恢復戒嚴[獨裁統治]的夢魘。

 

 

甚麼是[戒嚴]? 對於現在年輕人是一個陌生的名詞，讓我用[戒嚴往事]給年輕人一個比較具體的概念:

 

(一)  五十年前，我住在高雄(哈瑪星)，經常用走路的到(西子灣)游泳，每次在路途中看到憲兵沿路林立，我就知道有一個中國來的[臭頭仔-蔣公]要到他的(西子灣行館)ku-ke，當臭頭仔的車隊接近100公尺時，憲兵即命令所有行人原地站住不許動，等到車隊遠離，才可繼續行走。

五十年後又來了一個中國人，叫做[共匪-陳雲林]，他的人到哪裡，台灣人的行路權及日常活動都要受到限制，受到干擾。

 

只要遇到[中國權貴]，台灣人就倒楣，就要被罰站，被限制，被羞辱。

 

【在我的概念裡，[外省權貴] 和 [外省人]，這兩者是有分別的，所有認同台灣的[外省人]我都視之為同胞，心中只有大中國的[外省權貴]是不在其列的，這就是我做為一個台灣人的觀念】 

 

 

 

(二)五十年前，有一次我在西子灣入口的憲兵崗哨，看到我認識的兩個年輕老師站在崗哨旁邊，我上前問:[你們怎麼站在這裡?] 他說:[腳踏車雙載，被罰站]；

 

大家想想，一對情侶只是因為腳踏車雙載，就要被公開在馬路上罰站羞辱，一個站崗的士兵竟然擁有可以命令行人罰站的權力，這就是獨裁政權的恐怖。

 

『順便一提，這個被罰站的女老師是家姊台南師範的同學，當年借住在我家，她是外省人，一起被罰站的未婚夫也是外省人，顯然一個獨裁的政權，才不會管你是台灣人或外省人。』

 

 

五十年後的今天，馬政府掌控下的任何一個警察，都可以限制干涉人民的生活起居，只要你的服裝或攜帶的物品讓警察[不爽]，不必要有甚麼理由，警察 就可以打你，抓你，逮捕你。

 

 

你不可以爬山，郊遊，不可以進餐館喝咖啡，商店不可以賣唱片，歌曲讓警察聽起來[逆耳]，就會進入你家做[全套服務]-----不只給你[關機]，還會幫你[關門]。

 

 

北投分局長李漢卿，國民黨的立委羅淑蕾及統媒口徑一致的說:

[(上揚唱片行)播放「台灣之歌」的音樂聲音擾亂了鄰居安寧]。

 

 

奇怪啦! 我們不是有噪音管制法嗎? 取締噪音應該是屬於環保局主管的業務吧。

 

 

再者，(愛國同心會)在紅衫軍作亂時，一連幾天在深夜以高分貝喇叭繞著陳水扁總統的官邸 四周播放，陳總統家人及周遭住戶的安寧又怎麼講? 台北市警局你們曾經取締過嗎?

 

 

  [上揚唱片行]的(台灣之歌)不可以播，[愛國同心會]的(梅花)可以放，這是甚麼狗屁執法?

 

 

五十年前戒嚴時期，台灣人至少有一個可以[遵循]的惡法，我們知道甚麼事情不可以做，甚麼話不可以講，甚麼路不可以走；

 

 

而這次陳雲林到台灣來的各種管制，根本讓台灣人不知所從，不知所措，[衣、食、住、行]全部管制，也不知管制區在哪裡? 或到底犯了甚麼法，一有質疑或反抗，警棍隨即猛敲下來，警察以[自由心證]臨檢行人，任意闖進商店、旅館私人房間-----，憲法的基本人權蕩然無存，台灣成了[比戒嚴更恐怖的警察國家]。

 

 

民進黨已成立律師團，另外[司改會]、[律師公會]都要追究控告執法過當亂打人的警察，這是正確的做法，因為這次[圍城]的起因就是警察用暴力濫權執法，不管是立委、議員、一抓到就掐脖子，扭手臂，強加拖行，連在警察大學上過課的黃越綏老師要求進入國賓飯店喝一杯咖啡也不行，最後在警察的推擠中昏倒送到台大醫院。

 

 

想想，如果連黃越綏這樣長年為台灣社會奉獻的人，也是曾任警察學校的老師，照樣被警察修理，那麼無名小卒的我們，在[警察暴力]之下，生活又有甚麼保障呢?

 

 

這些警察只知道受命於長官，以為有長官做靠山，全然無視於憲法對人民的基本人權，如果律師團以法律追究這些執法過當或違法的警察應負的責任與刑責，那麼今後警察執法時，就會在服從長官命令與違法被懲處之間去思考 [正當執法]，而不至於違法濫權。

 

 

我相信追究警察濫權的執法，此舉對於台灣未來公務員執法的教育一定有正面的作用。

Barack Obama will take office as the new US president in January China's government has urged America's new president-elect, Barack Obama, to oppose independence for Taiwan. A foreign ministry spokesman said the issue was key to good relations. The demand comes after Taiwan's President Ma Ying-jeou held a brief but historic meeting with a senior Chinese envoy in the Taiwanese capital, Taipei. But the meeting was vehemently opposed by thousands of protesters, who object to the closer trade and economic ties agreed in a deal this week. Taiwan has been ruled separately since the end of the Chinese civil in 1949; the defeated Kuomintang retreated to Taiwan to create a self-governing entity. In the future both sides should see the reality and should not deny each other's existence Taiwan President Ma Ying-jeou Earlier in the week, Mr Chen agreed a landmark deal to improve direct trade and transport links, and on Thursday, he held a short but historic meeting with President Ma. The two made a few cordial remarks as they exchanged gifts - a painting of a horse for President Ma (whose name means "horse" in Chinese), and a ceramic vase for Mr Chen. But Mr Chen's avoidance of the term "president" when addressing Mr Ma - a term Beijing considers would suggest Taiwan's independence - infuriated protesters gathered outside the government guesthouse where they met. Fears for jobs "This shows that China is only treating Taiwan like a local government," said Chang Bang-ni, a middle-aged businesswoman demonstrating outside. Some protesters also voiced fears that closer economic ties with China could mean jobs lost on the island to the cheaper market on the other side of the Taiwanese Straits. President Ma says this week's deal "symbolises a major step forward for cross-strait ties," and will "contribute to cross-strait stability and prosperity". "But we cannot deny that differences and challenges still exist, such as Taiwan's security and Taiwan's position in the international community," he said in comments broadcast live. "In the future, both sides should see the reality and should not deny each other's existence in order to promote the welfare of the people and cross-strait peace and to resolve our differences." Mr Chen's visit has attracted daily protests since it began on Monday, and thousands of police have been deployed to ensure his safety. On Wednesday night, crowds mobbed the hotel in which Mr Chen was eating, preventing him from leaving the building until well after midnight. Last month, his deputy Zhang Mingqing was knocked to the ground by protesters during a visit.

Chen Yunlin's visit has prompted small pro-independence protests China and Taiwan have signed landmark agreements to improve direct trade and transport links, following the highest-level Chinese visit in decades.         The agreements are set to triple the number of weekly direct passenger flights and allow cargo shipments between ports in China and Taiwan. They also aim to improve the postal service and food safety. China claims sovereignty over Taiwan though they have been separately governed since 1949. The agreements were announced on the second day of a five-day visit to Taiwan by Chen Yunlin, China's top official for handling relations with Taiwan. Previously, sovereignty issues involving vessels and crews forced costly detours through third countries, while China-Taiwan flights were forced to stop in Hong Kong or Macau. Under the agreements: Direct charter flights will increase from 36 to 108, and can operate daily rather than four days out of seven Routes will be shortened and private business jet flights will be allowed Direct cargo shipments will be allowed between 11 Taiwan sea ports and 63 in China, tax free Sixty direct cargo flights will be allowed per month Direct postal links will be expanded to improve delivery time, currently up to 10 days Food safety alerts between the countries will be set up.   Taiwan has the diplomatic recognition of a handful of states. But since Mao Zedong's Communists won the Chinese civil war and the defeated Kuomintang fled to Taiwan, China has regarded it as a breakaway province which it has threatened to reunify using force.     Taipei protests The latest trade agreements come after the two sides held their first, high-level meeting in a decade in June this year, in Beijing.   The improvement in relations follows the election of President Ma Ying-jeou in Taiwan. Viewpoints: China-Taiwan deal   However, Mr Ma's overtures of ending decades of political rivalry with Beijing have sparked fierce protests in Taiwan, including accusations that he is "selling out" to the mainland. Pro-independence groups staged small protests around Taipei to coincide with Mr Chen's visit, waving flags and banners.   Thousands of police were deployed to ensure Mr Chen's safety, after his deputy Zhang Mingqing was jostled and knocked to the ground by protesters during a visit to Taiwan in October.   SUPPER HUANG, COMPANY MANAGER, 58, TAIPEI, TAIWAN Taiwan is an independent country with our own government, military, and judiciary. We have all the features of a sovereign state and we separated from China many years ago. We can talk to China on state-to-state business, just like EU member states talk to the US. But Taiwan's current government did not press the issue of Taiwan's sovereignty. This deal seems unfair to me because there was no equality between Taiwan and China. We did not even use our formal name - Taiwan - during the negotiations. Maybe there will be improved relations between the two sides and this is good - but we still worry that closeness to China might end up bringing us trouble in the future. I want to see the government talk openly about sovereignty rather than economics and trade. There was no public say in the current negotiations. Our congress could not monitor the talks . If there was some participation by the public or the congress, then I might have more confidence. XIAN, STUDENT, GUANGZHOU, CHINA I have always felt that Taiwan was a part of China. I am happy about the cross-strait trade deal. If trade relations improve, both sides will become friends. I think this deal is good for both sides of the Taiwan Strait, because shorter flight routes, shipping and other features will save us all money and time. This deal is not about political but about economic and trade relations. But even closer links - whatever they are - can be positive. I feel that if China becomes more democratic then Taiwanese people might become happy to be part of China. In mainland China today, we have no democracy. I am a university student and I know my fellow students feel that democracy is a requirement for China. I think Taiwan is a good example for China. In the past Taiwan was similar insofar as it was only ruled by one party - the Kuomintang. Today, the mainland of China is ruled by one party. If the Kuomintang can change, surely the Chinese Communist Party can change? This is long and difficult road, but I hope that China will complete it and win the respect of the rest of the world as a democratic country.
